Child Custody

Definition: Before the child custody case, Pennsylvania v. Addicks, 1813, it was an American legal principle that no matter what the cause of divorce, the father had the right to custody of all children if he asserted that right. There were few exceptions if the father asserted this right.

The Pennsylvania v. Addicks case was significant in that it introduced the principle of deciding child custody based on "the best interests of the child."
